Who owns the fence?

This is a frequently posed question. Whose property is the fence around your garden? There is no doubt if the home is detached the homeowner must take care of it. The situation may be trickier if the fence is shared by properties next door.

Contrary to popular belief, each house is not liable for the fence that is visible when facing the house from the road.

The only certain way to determine ownership is if it is noted on the property’s deeds. A T-mark or a description may be used to signify this. Surprisingly, the question is rarely posed before a purchase, and the topic only comes up when the fence needs to be modified.

Do I need planning permission?

Rarely will a typical family home require planning clearance to construct a fence. The Planning Portal website has more in-depth information, however the general guidelines are as follows:

The fence is no taller than 2 metres overall
If you are replacing an existing fence that is already over 2 metres, the new fence should be no higher.
The fence shouldn’t be higher than 1 metre if it’s near to a road or a pedestrian path next to a road.
The fence neither surrounds nor separates a listed building.
The ability to build a fence has not been restricted by a different direction or planning requirement.

Who gets the best side?

You do. Since it is your fence, you are free to use it anyway you like. The belief that you must provide your neighbour with the best side is untrue. When your neighbour decides to erect a fence, he benefits from having the best side. Everyone will be satisfied if you choose a fence that is the same on both sides out of consideration. If security is an issue, keep in mind that fences with arris rails are easier to scale, thus it’s occasionally preferable to have the work side in your garden.

Can I paint or hang plants on my neighbour's fence?

If you have permission, only. If you want to paint the side that faces your property, your neighbour must approve. If your neighbour has a fence, you can plant free-standing plants and shrubs next to it or build your own fence next to it on your side of the property line (the boundary will run between the 2 fences even if they are touching).

Additionally, you are not permitted to attach boards, panels, or trellises to your neighbour’s fence in order to support plants or hide the fence without their permission.

Any unauthorised modifications you make to your neighbour’s fence (as mentioned above) may constitute criminal damage.
