Use of Our Website
You agree to use our website only for lawful purposes and in a way that does not damage, interrupt or interfere with the operation of the website.
We may update, change, remove or suspend any part of our website at any time without notice.
We do our best to keep product information, prices, stock availability and delivery information accurate. However, errors may occasionally occur, and we reserve the right to correct any errors or omissions.
Product Information
We make every effort to describe and display our products as accurately as possible.
Product images are for illustration purposes only. Colours, finishes, grain patterns, treatment shades and product appearance may vary from the images shown on our website.
Measurements, sizes and product specifications are approximate and may be subject to normal manufacturing tolerances.
Where products are supplied by third-party manufacturers, product descriptions, specifications, guarantees and technical details may be based on information provided by the manufacturer.
Natural Product Disclaimer
Many of the products we sell are natural, heavy-duty or outdoor construction products. They may have natural variations and characteristics that are not considered faults.
Timber products may include knots, splits, shakes, grain variation, colour variation, resin, movement, twisting, bowing, warping, surface marks and treatment marks.
Pressure-treated timber may vary in colour and appearance. It may also weather naturally over time when exposed to outdoor conditions.
Concrete products may include small chips, surface marks, air holes, colour variation, hairline cracks, mould marks and efflorescence. Efflorescence is a natural white bloom that can appear on concrete products and is not normally considered a product fault.
Composite products may be subject to colour variation, expansion, contraction and normal weathering. They must be installed in accordance with the relevant manufacturer guidance.
These natural and manufacturing characteristics do not usually affect the intended use of the product.
Product Suitability
It is the customer’s responsibility to ensure that the goods ordered are suitable for their intended use, installation method, site conditions and measurements.
Any advice provided by Sky Fencing Ltd is given in good faith and based on the information supplied by the customer. We cannot accept responsibility where incorrect measurements, site conditions or installation requirements have been provided to us.
Customers should seek professional advice where they are unsure about product suitability, structural requirements or installation methods.
Orders
When you place an order with us, you are making an offer to purchase the goods listed in that order.
An order is not accepted by us until it has been reviewed, processed and confirmed. We reserve the right to refuse, cancel or amend an order where necessary.
We may refuse or cancel an order if goods are unavailable, a pricing error has occurred, payment has not been received, delivery is not possible, or the order appears to be fraudulent or incorrect.
Order Details
Customers are responsible for checking all order details carefully before completing checkout.
This includes product sizes, quantities, colours, delivery address, contact details, delivery method and any special instructions.
Once an order has been placed, we are unable to add, remove or change items on the order. If additional products are required, a new order must be placed separately.
Delivery addresses cannot be changed once an order has been placed. Customers are responsible for ensuring the delivery address is correct before payment is made.
If you notice an error after placing your order, please contact us as soon as possible. While we will always try to help where possible, changes cannot be guaranteed once the order has entered our picking, preparation or delivery process.
Stock Availability
All goods are subject to availability.
Our website may not always show live stock levels. Stock availability can change quickly, especially during busy periods.
If an item is out of stock or unavailable after your order has been placed, we may contact you to offer an alternative product, wait for new stock to arrive, split the order where possible, or cancel and refund the unavailable item.
Prices
All prices shown on our website are in pounds sterling.
Prices may be shown including VAT, excluding VAT, or both, depending on the page or customer account type.
We reserve the right to change prices at any time without notice. Price changes will not normally affect orders that have already been accepted and paid for, unless there has been an obvious pricing error.
If a product is listed at an incorrect price due to an error, we reserve the right to cancel the order or contact you to confirm whether you wish to proceed at the correct price.
Trade Prices and Discounts
Trade prices, account prices, discount codes and promotional offers are offered at our discretion and may be changed, suspended or withdrawn at any time.
Trade pricing may differ between online orders, in-store purchases, quotation prices and trade counter prices.
Discount codes must be entered at checkout and cannot usually be applied after an order has been placed.
Promotions, offers and discounts cannot be combined unless clearly stated.
Payment
Payment must be made in full at the time of order unless we have agreed alternative payment terms in writing.
We reserve the right to withhold goods, delay delivery or cancel an order if payment has not been received in full.
Ownership of goods remains with Sky Fencing Ltd until payment has been received in full.
Fraud Checks
We reserve the right to carry out security and fraud checks on any order.
Where necessary, we may request additional information to verify the order, payment method, billing address or delivery address.
We may cancel or delay an order if we believe it may be fraudulent, suspicious or unauthorised.
Delivery
Delivery is subject to our Delivery Policy, which forms part of these Terms and Conditions.
Delivery charges are calculated based on delivery postcode, order value and delivery zone.
Delivery dates and times are estimates only and are not guaranteed.
We cannot accept responsibility for costs, losses or delays caused by customers booking installers, landscapers, tradespeople or other third parties before goods have been delivered and inspected.
Kerbside Delivery
Unless otherwise agreed in writing, all deliveries are made on a kerbside delivery basis.
Our drivers will unload goods to the nearest safe and reasonably accessible location at the delivery address.
Drivers cannot carry goods through houses, through buildings, over walls or fences, into rear gardens, up or down steps, across long distances or to the final installation location.
The final unloading point is at the driver’s discretion and will depend on access, product weight, safety, ground conditions and space available.
Delivery Access
Customers must ensure that suitable access is available for our delivery vehicles.
You must inform us before delivery if there are any access restrictions, including narrow roads, low bridges, weight restrictions, parking restrictions, red routes, private roads, gated entrances, overhanging trees, steep driveways or limited turning space.
If delivery cannot be completed due to unsuitable access, incorrect delivery information or circumstances outside our control, a redelivery charge may apply.
Risk and Responsibility
Risk in the goods passes to the customer once the goods have been delivered to the delivery address or collected from our premises.
Where goods are left without anyone present, responsibility for the goods passes to the customer once delivery has been completed.
We may use photographs, signed delivery notes, vehicle tracking records and driver records as proof of delivery.
Collections
Collection orders are separate from delivery orders.
Customers must wait until they have received confirmation that their order is ready for collection before travelling to collect.
Customers collecting goods are responsible for bringing a suitable vehicle and ensuring that goods are loaded, transported and secured safely.
We reserve the right to refuse loading where we believe a vehicle is unsuitable or the goods cannot be transported safely.
Cancellations by Consumers
If you are a consumer purchasing online, by phone or by email, you may have the right to cancel your order within 14 days of receiving the goods, unless an exemption applies.
To cancel an order, you must contact us clearly stating that you wish to cancel.
Goods must be returned unused, uninstalled, undamaged and in a resaleable condition.
The customer is responsible for the cost of returning goods unless the goods are faulty, damaged or incorrect.
Certain goods may not be eligible for cancellation or return, including goods that have been cut, altered, made to measure, made to order, specially ordered, personalised or mixed to the customer’s specification.
Your statutory rights are not affected.
Cancellations by Business and Trade Customers
Business and trade customers do not have the same automatic cancellation rights as consumers.
Cancellation requests from business or trade customers are accepted at our discretion.
Special order items, made-to-order goods, bespoke products, cut materials and goods ordered specifically for a business customer cannot usually be cancelled once ordered.
Returns
Returns are subject to our Returns and Refund Policy.
Goods must be returned in a clean, unused, uninstalled, undamaged and resaleable condition.
We reserve the right to refuse a return or reduce a refund where goods have been used, installed, damaged, cut, altered, stored incorrectly or are no longer in resaleable condition.
Customers are responsible for ensuring returned goods are suitably packaged and protected during return transport.
Damaged, Missing or Incorrect Goods
Please inspect your goods as soon as possible after delivery or collection.
Any damaged, missing or incorrect goods must be reported to us within 48 hours of receipt wherever possible.
When reporting an issue, please provide your order number, a clear description of the issue and photographs where relevant.
Please do not install, cut, alter or use any goods that you believe are damaged, incorrect or faulty until we have had an opportunity to review the issue.
Your statutory rights are not affected.
Faulty Goods
If goods are faulty, not as described or not of satisfactory quality, please contact us as soon as possible.
We may ask for photographs, videos or other information to help assess the issue.
Where appropriate, we may offer a repair, replacement, partial refund or full refund depending on the circumstances and your legal rights.
We are not responsible for faults caused by incorrect installation, misuse, unsuitable site conditions, normal wear and tear, accidental damage, weathering, poor maintenance or failure to follow manufacturer guidance.
Refunds
Approved refunds will usually be made to the original payment method.
Refund times may vary depending on the payment provider or bank.
We may withhold a refund until goods have been returned to us or until satisfactory evidence of return has been provided.
Where a refund is reduced due to damage, use, missing parts or loss of value, we will explain the reason for the reduction.
Manufacturer Guarantees and Warranties
Some products may include a manufacturer guarantee or warranty.
Manufacturer guarantees and warranties are provided by the manufacturer and are subject to the manufacturer’s own terms, conditions, exclusions and claim procedures.
A manufacturer guarantee does not replace or limit your statutory rights.
Installation
Unless expressly agreed in writing, Sky Fencing Ltd supplies goods only and does not provide installation services.
Customers are responsible for arranging installation and ensuring goods are installed correctly and safely.
We cannot accept responsibility for installation costs, removal costs, labour costs or consequential losses where goods have been installed before being checked.
Product Care and Storage
Customers are responsible for storing goods correctly after delivery or collection.
Timber, panels, posts, sleepers, composite materials and other outdoor products should be stored safely, supported correctly and protected from unsuitable conditions before installation.
We cannot accept responsibility for damage caused by poor storage, misuse, incorrect handling or delayed installation after delivery.
Quotations
Any quotation provided by Sky Fencing Ltd is based on the information supplied at the time.
Quotations may be subject to stock availability, price changes, delivery charges and product availability.
Unless stated otherwise, quotations are not guaranteed indefinitely and may expire or be withdrawn.
It is the customer’s responsibility to check that the quotation includes the correct products, sizes, quantities and delivery details before placing an order.
Website Errors
We reserve the right to correct website errors, including pricing errors, stock errors, product description errors, image errors and technical issues.
If an error affects your order, we may contact you to discuss the issue, offer an alternative, amend the order or cancel and refund the affected item.
Limitation of Liability
Nothing in these Terms and Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to the above, Sky Fencing Ltd shall not be liable for indirect losses, loss of profit, loss of business, loss of opportunity, loss of goodwill, installation costs, labour costs, removal costs, third-party costs or consequential losses.
Our total liability for any order shall not exceed the total price paid for the goods giving rise to the claim, except where the law states otherwise.
Events Outside Our Control
We shall not be responsible for any failure or delay caused by events outside our reasonable control.
This may include severe weather, traffic delays, road closures, vehicle breakdowns, supplier delays, stock shortages, labour shortages, industrial action, accidents, fire, flooding, power failures, system failures, government restrictions or other circumstances beyond our control.
